| dc.description.abstract | Covid-19 pandemic which creates panic, fear and uncertainty in every part of society is threatining life seriously. Covid-19 pandemic constitutes a reaction in society with measures that decelerating or stopping social and economic life. The react by society is existing by unwearing a mask, violating social distance rules, violating the quarantine measures. It’s undeniable that the reaction’s reasons are economical dynamics. Lockdowns for those who have to work for economic reasons, quarantine practices at home cause job losses, and therefore those who have to work tend to break these bans. However, in order to get out of the pandemic situation, a cooperation should be established between infected patients and the administration. Failure to ensure the said cooperation for economic reasons or other dynamics will result in the state authority using its penalizing authority. In this respect the crime of violating the measures related to infectious diseases is one of tools of state which uses as a last resort so as to ensure adapted to the measures. In this paper, the elements of TCK m.195 crime are examined and the applicability of the relevant crime is discussed in the case of Covid-19. | tr_TR |
